Returns / Right of Withdrawal
Returns / Right of Withdrawal
1. When the customer may withdraw from the contract
If the purchase contract is concluded at a distance via the online shop, the consumer has the right to withdraw from the contract without giving any reason within 14 days from the day the goods are received. To meet the deadline, it is sufficient to send the notice of withdrawal no later than the last day of this period.
2. How to withdraw
You may withdraw by any clear statement, for example by email to info@miolka.cz or by letter to the address given in point 3. You may also use the Miolka Withdrawal / Return Form, but its use is not mandatory.
Please include in your withdrawal:
- your full name,
- the order number,
- which goods the withdrawal relates to,
- your bank account number for the refund, if you wish to receive the payment by bank transfer.
Please do not send the goods back without contacting me by email first. After receiving your withdrawal, I will send you further instructions.
3. Where to send the goods
After agreeing by email, please send the returned goods to:
Kateřina Kolářová, DiS.
Company ID (IČO): 01968947
Zdeňka Štěpánka 1785/5
708 00 Ostrava-Poruba
Czech Republic
Shipping via Packeta (Zásilkovna), Balíkovna, a PPL box or any other method is only possible after prior agreement.
4. Deadline for returning the goods
After withdrawing from the contract, the customer must send or hand over the goods no later than 14 days after the withdrawal.
5. Condition of returned goods
Returned goods should be:
- clean,
- complete,
- in their original packaging where possible,
- free of signs of use beyond normal trying on.
The consumer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
6. When withdrawal is not possible
The 14-day right of withdrawal does not apply in particular to goods:
- made to the customer's specifications,
- adjusted according to parameters entered by the customer,
- clearly personalised to the customer's needs.
At Miolka, this exception applies in particular to products sewn to measure or adjusted according to the customer's individual choices, such as the specified circumference, type of fastening, type of pocket, window, orientation or other selected parameters. For standard stock items without individual adjustment, the consumer may exercise the right of withdrawal unless another statutory exception applies.
7. Gift vouchers
The consumer may withdraw from the purchase of a gift voucher within 14 days from the date of purchase, provided the voucher has not yet been redeemed. I will refund the amount paid by the same method it was received and cancel the voucher code.
If the customer withdraws from a purchase of goods paid for in full or in part with a gift voucher, I will return the part paid with the voucher as a new gift voucher of the same value. Any part paid by other means will be refunded by the same method it was received.
8. Refunds
If the withdrawal is valid, I will refund the customer without undue delay, and no later than 14 days after the withdrawal, all payments received, including delivery costs up to the amount of the cheapest delivery option offered. I will refund by the same payment method used, unless we agree otherwise. I may withhold the refund until I have received the goods back or until the customer has supplied evidence of having sent them back, whichever is earlier.
9. Cost of returning the goods
The customer bears the cost of returning the goods to the seller.
10. Business purchases
The 14-day right of withdrawal without giving a reason applies to consumers. If the order is placed as part of a business activity (with a company ID), this right does not apply under consumer protection rules.
11. Final provisions
This document sets out the conditions for returning goods and withdrawing from the contract for purchases in the Miolka online shop. If the laws of the country in which the consumer has their habitual residence provide the consumer with a higher level of protection, those laws shall apply.
